
Commercial litigation relates primarily to commercial and business transactions and covers disputes in a wide spectrum of areas of law such as contract law, sale and purchase of businesses, supply of goods and services, company and partnership law, franchising and trade practices law (including misleading and deceptive conduct and unfair market practices). This list is not exhaustive.
There may be issues arising from poor due diligence investigation in domestic or commercial property transactions; misrepresentation in negotiation of a contract; disputes arising over disposal of partnership or company assets, or the application of a partnership or company’s funds; or there may be simply a breakdown of communication between partners or between company directors making the situation unviable in relation to the running of a business.
In some cases, dispute resolution processes may be appropriate and may need to be considered before resorting to litigation. In other cases, it may be appropriate to commence Court Proceedings at the earliest opportunity in order to assert rights in relation to certain issues.
Proper legal advice is necessary at the earliest stage in a dispute so that the correct steps are taken to achieve the best outcome for the client with regard to the particular dispute in question.
